These Terms & Conditions ("Terms") govern your use of the Vigalant website (vigalant.com) and the booking and provision of inspection and related services ("Services") by Vigalant, NIF 517281848, based in Lagos, Algarve, Portugal. By using our website or booking our Services, you agree to these Terms.
Vigalant provides independent, third-party inspection and secret-shopper assessment services for short-term rental (Alojamento Local / AL) and holiday-home properties, including: AL secret shopper inspections, property condition inspections, move-in/move-out and real estate inspections, logistical and on-site support, and digital presence services, as described on our Services page.
Enquiries submitted through our website, phone, or email are not binding until confirmed in writing by Vigalant. Pricing shown on our Pricing page is indicative and excludes IVA; final pricing depends on property size, location, and any add-ons selected, and will be confirmed before your booking is scheduled.
A deposit of 50% of the agreed inspection cost is required to confirm your booking. The remaining balance is due on delivery of your inspection report. Payment is accepted by bank transfer or cash. Balances are payable within 7 days of invoice, unless otherwise agreed in writing. Late payment may delay report delivery or future bookings.
We understand that plans change, particularly as many of our clients manage their properties remotely. If you need to reschedule or cancel a booked inspection, we require at least 24 hours' notice ahead of the scheduled appointment. Cancellations or rescheduling requests made with less than 24 hours' notice will incur a fee of €45, to cover the reserved time.
Our Monthly Quick Check and Quarterly Full Inspection plans are ongoing services billed on a recurring basis (monthly or quarterly, in advance). There is no minimum term — you may cancel an ongoing plan at any time by giving at least 14 days' written notice ahead of your next scheduled billing date. Cancelling with less notice may result in that period's payment still being due, as the visit will typically already be scheduled.
The Monthly Quick Check provides a general visual and video record of the property's condition, together with a basic functional check (taps and water) and a brief garden and pool check. It does not include room-by-room video or photography, detailed room-by-room notes, external wall photography, or the maintenance check included with the Quarterly Full Inspection, and should not be relied upon as a substitute for a full inspection where detailed, room-level documentation is required. The Quarterly Full Inspection is our complete, thorough service and is the appropriate plan wherever detailed condition documentation is needed.
The Quarterly Full Inspection includes external wall photography and a visual check for signs such as water ingress or cracking, together with full pool and garden inspections; this is a photographic record only and does not constitute a structural assessment or diagnosis, consistent with Section 7 (Nature of our reports) above. A full inventory count is available as a paid add-on to the Quarterly Full Inspection at the rate shown on our Pricing page.
If you are a consumer booking our Services remotely (via our website, phone, or email) rather than in person, you have a statutory right to withdraw from the contract within 14 days without giving a reason, in line with EU consumer protection rules. By requesting an inspection date within this 14-day period, you expressly request that we begin providing the Service before the withdrawal period ends and acknowledge that, once the Service has been fully performed, you lose your right of withdrawal. Where an inspection is cancelled during the withdrawal period before it has taken place, any amount already paid will be refunded, less a reasonable amount for any work already carried out.
Our inspection reports reflect our professional, independent observations at the specific date and time of the visit. They are a snapshot assessment — not a guarantee, warranty, or formal certification of a property's condition, compliance, or fitness for any particular purpose — and should not replace specialist structural, electrical, or legal due diligence where that is required.
Vigalant operates independently of the property management companies, letting agents, and caretakers referenced in our reports. Our assessments are objective and are not influenced by any commission or referral arrangement with the businesses we review.
You agree to provide accurate property access details and any relevant instructions ahead of a scheduled inspection. Vigalant is not liable for delays or incomplete inspections caused by inaccurate access information, or by third parties (e.g. property managers, keyholders) failing to grant access.
To the maximum extent permitted under Portuguese law, Vigalant's liability for any claim arising from our Services is limited to the fees paid for the specific inspection giving rise to the claim. We are not liable for indirect, incidental, or consequential losses. Nothing in these Terms limits liability that cannot be excluded under Portuguese law, including liability for death or personal injury caused by negligence, or fraud.
All content on this website — including text, images, logos, and report templates — belongs to Vigalant or its licensors and may not be reproduced without permission.
We treat property and client information as confidential and will not share inspection reports with third parties without your consent, except where necessary to deliver the Service or where required by law.
If you are unhappy with any aspect of our Services, please contact us at info@vigalant.com in the first instance so we can address it directly. As a business operating in Portugal, we maintain a complaints book (livro de reclamações) in line with Portuguese consumer protection requirements, available on request.
If we are unable to resolve a complaint directly, as a consumer you may refer the matter to the Algarve's Alternative Dispute Resolution (ADR) entity: CIMAAL – Centro de Informação, Mediação e Arbitragem de Conflitos de Consumo do Algarve, Edifício Ninho de Empresas, Estrada da Penha, 8005-131 Faro, Tel: 289 823 135. A full list of ADR entities in Portugal is also available at www.consumidor.pt. If your dispute relates to a service booked online, you may also use the EU's Online Dispute Resolution platform.
Vigalant is not liable for any failure or delay in performing our Services where this is due to circumstances beyond our reasonable control, including extreme weather, illness, government restrictions, or failure of third-party access to a property.
These Terms are governed by the laws of Portugal. Disputes are subject to the exclusive jurisdiction of the Portuguese courts, without prejudice to any mandatory consumer protection rights you may have.
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
These Terms, together with any written quote or booking confirmation, constitute the entire agreement between you and Vigalant regarding the Services, superseding any prior discussions or representations.
We may update these Terms from time to time. Continued use of our website or Services after changes are posted constitutes acceptance of the revised Terms.
